Terms of Service

These Terms of Service govern your use of the Hey Wendi website at heywendi.com (the “Site”), operated by Sasstastic Life LLC d/b/a Hey Wendi (“we,” “our,” or “Hey Wendi”). By using the Site, you agree to these Terms.

If you don’t agree with these Terms, please don’t use the Site. If something here isn’t clear, email [email protected].

1. Who can use the Site

The Site is intended for adults. By using the Site, you confirm that you are at least 18 years old.

2. What the Site is and isn’t

The Hey Wendi website provides information about Hey Wendi’s services and allows you to:

* Learn about our offerings (Done Being Fine sessions, The Clarity Room, The Whole Picture workshops)

* Book a Done Being Fine session and pay for it

* Submit an inquiry for The Clarity Room or The Whole Picture

* Send us a general message through the Let’s Talk contact form

* Take the “Are You Actually Fine?” quiz

Visiting the Site, submitting an inquiry, or downloading anything we offer does not create a coaching relationship. A coaching relationship is only created when you and Hey Wendi enter into a separate Client Services Agreement (the “CSA”) governing the specific services you’re purchasing.

IMPORTANT: This is not therapy

Hey Wendi provides coaching services, not psychotherapy, medical care, or mental health treatment.

Wendi Fredregill is a certified coach. She is not a licensed therapist, counselor, psychologist, social worker, doctor, or attorney.

If you are experiencing a mental health crisis or have urgent medical needs, please contact a licensed professional, dial 988 (Suicide & Crisis Lifeline in the US), or go to your nearest emergency room.

3. Bookings, payments, and the CSA

Done Being Fine sessions

When you book a Done Being Fine session through the Site, you agree to pay the session fee in full at the time of booking via our payment processor, Stripe.

You may reschedule once at no charge with at least 24 hours' notice. We'll find a new time that works.

Requests made with less than 24 hours' notice, or a second reschedule, are handled case by case — email [email protected] and we'll work it out together.

If you don't attend and haven't reached out, the session is considered used and is not eligible for a refund or reschedule.

Once the session has been held, it is non-refundable. You did the work; we showed up; the exchange is complete.

The Clarity Room

The Clarity Room is offered by inquiry only. Submitting an inquiry through the Site does not create a binding agreement. A binding agreement is created only when you and Hey Wendi sign a separate Coaching Service Agreement for The Clarity Room and your first payment is processed.

The Whole Picture workshops

The Whole Picture workshops are offered by inquiry only. Submitting an inquiry does not create a binding agreement. A binding agreement is created only when you and Hey Wendi sign a separate workshop booking agreement and your deposit or full payment is processed.

Payments and refunds

All payments are processed by Stripe and are subject to Stripe’s own terms. Payment terms, refund policies, and cancellation rules for each specific service are governed by the applicable Coaching Service Agreement. By default, fees are nonrefundable once services begin, except as expressly stated otherwise in the applicable agreement.

4. Our content and intellectual property

Everything on the Site — the words, the images, the design, the logo, the methodology references, the brand colors, the structure — is owned by Sasstastic Life LLC d/b/a Hey Wendi (or licensed to us by third parties, such as Qnity for the QLife Map methodology used in The Whole Picture).

You’re welcome to:

* Read, share links, and reference us in conversation or writing with proper attribution

* Take screenshots for personal reference

* Share quotes with attribution to Hey Wendi

You may not:

* Copy, republish, or redistribute substantial portions of our content without permission

* Use our brand name, logo, or trademarks in your own marketing without permission

* Use our methodology, frameworks, or any proprietary materials we provide as part of our services for commercial purposes

* Use any of our content to train AI models or build a competing service

If you want to feature Hey Wendi in your own content (a podcast, a newsletter, a workshop, an article), just ask. We usually say yes when it’s a good fit.

5. The Qnity QLife Map attribution

The Whole Picture workshop uses the QLife Map methodology, which is a trademarked tool of Qnity. Wendi Fredregill is a certified Qnity practitioner. The QLife Map and 9Grid notebook are proprietary tools of Qnity. References to these tools on the Site or in our services are made with permission as part of Wendi’s certification. Workshop participants may use the materials they receive (their own QLife Map poster, their 9Grid notebook) for personal reference only.

6. The quiz and other free resources

Our “Are You Actually Fine?” quiz, blog content, and any other free resources we provide are offered as-is for educational and informational purposes. They are not a substitute for professional advice and do not create a coaching or therapeutic relationship.

7. Your conduct on the Site

When using the Site, you agree not to:

* Submit false, misleading, or fraudulent information

* Use the Site or our contact forms to send unsolicited commercial messages, spam, or harassment

* Attempt to access parts of the Site that are not publicly available

* Interfere with the Site’s operation or security

* Use the Site for any unlawful purpose

We reserve the right to refuse service, block submissions, or terminate accounts of users who violate these terms.

8. Disclaimers and limitations

No guarantees of outcome

Coaching is a collaborative process. The outcomes you experience depend on many factors, including your own commitment, effort, and circumstances. Hey Wendi does not guarantee any specific result, outcome, change, or improvement in your life as a result of our services.

Information on the Site

The information on the Site is provided for general informational purposes. While we do our best to keep it accurate, we make no warranties about its completeness, reliability, or suitability for any specific purpose.

Third-party links

The Site may contain links to third-party websites (Qnity, Stripe, Zoom, etc.). We are not responsible for the content, privacy policies, or practices of those third-party sites.

9. Limitation of liability

To the maximum extent permitted by law:

* Hey Wendi’s total liability for any claim arising out of or related to your use of the Site shall not exceed the total fees you have paid to Hey Wendi in the 12 months preceding the claim (or $100 if you have not paid us any fees)

* Hey Wendi shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, lost data, or business interruption

* These limitations do not apply to liability that cannot be excluded by law, or to fraud, gross negligence, or willful misconduct

For clients who have signed a Coaching Service Agreement, the liability provisions of that Agreement also apply and may modify these terms with respect to the services governed by that Agreement.

10. Dispute resolution

Good-faith negotiation first

If you have a concern or complaint, please contact us first at [email protected]. We’ll do our best to resolve it directly.

Mediation

If direct negotiation doesn’t resolve the issue, the parties agree to attempt nonbinding mediation under the Commercial Arbitration Rules and Mediation Procedures of the American Arbitration Association (AAA), with costs shared equally.

Binding arbitration

If mediation is unsuccessful, any dispute arising out of or related to these Terms or your use of the Site shall be decided by binding arbitration in accordance with the Commercial Arbitration Rules and Mediation Procedures of the AAA and the Expedited Procedures set forth therein. The arbitration shall be venued in Des Moines, Iowa and conducted by a single arbitrator whose decision shall be final and binding. Hey Wendi shall have the right to recover reasonable costs, including reasonable attorneys’ fees, if it prevails.

Class action waiver

Disputes will be resolved on an individual basis. You and Hey Wendi each waive the right to participate in a class action, class arbitration, or representative action.

11. Governing law

These Terms are governed by the laws of the State of Iowa, without regard to conflict of law principles. By using the Site, you consent to the personal jurisdiction of the courts located in Polk County, Iowa for any matter not subject to arbitration.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we’ll update the “Last updated” date at the top. Material changes will be communicated to active clients via email. By continuing to use the Site after changes are posted, you accept the updated Terms.

13. Severability

If any provision of these Terms is found to be unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force.

14. Entire agreement

These Terms, together with our Privacy Policy and any applicable Coaching Service Agreement, constitute the entire agreement between you and Hey Wendi regarding your use of the Site. In the event of a conflict between these Terms and an applicable Coaching Service Agreement signed by both parties, the Coaching Service Agreement controls with respect to the services governed by that Agreement.
